Interim Possession Orders

An Interim Possession Order (or IPO) is perhaps the quickest and most effective legal basis on which to evict someone from your property. Introduced as part of the Criminal Justice and Public Order Act 1994, it has since been codified into the Civil Procedure Rules 1998 (p55/s3). Once served with a properly-ratified IPO, any squatters in your property must leave within 24 hours, or they will have committed a criminal offence, for which they can be arrested and subsequently charged by the police.

The IPO process

For an IPO to be legally binding, the proper legal process must be adhered to:

  • Solicitors issue an application for an Interim Possession Order against the trespassing persons.
  • The Court will list a hearing for the application no fewer than 3 days following the date of issue.
  • Within 24 hours of the interim hearing, our Enforcement Agent will be required to serve the Claim Form, the Application Notice, and a prescribed form on which the Defendant (the trespasser) can return their witness statement.
  • Once the IPO application is granted, a final hearing will be listed at the Court, no fewer than 7 days from the initial hearing.
  • Our Enforcement Agent then has 48 hours from the moment it is sealed to serve the IPO, the Claim Form, and any supporting evidence to the Defendant.
  • Obstructing an Enforcement Agent from executing a High Court Writ is a punishable offence under Section 10 of the Criminal Law Act (1977).
